(Oral) Prayer is for grant of anticipatory bail in case having FIR No.33 dated 17.9.2020 registered under Sections 302, 201, 34 IPC (Section 120-B IPC and Section 29 of NDPS Act added later on ) at Police Station Airport, Police Commissionerate Amritsar (Annexure P-1). FIR in this case was registered against the present petitioner and one Gurpreet Singh @ Gopi on the basis of the statement of complainantAmrik Singh wherein he alleged that the aforesaid persons murdered his son Gurpreet Singh. During investigation both the petitioners were found to be innocent by the police and the police presented the challan (Annexure P-2) against Dalbir Singh and Gurmandeep Singh while the petitioners were placed in column No.2 of the said challan. Thereafter the trial Court framed charges against said Dalbir Singh and Gurmandeep Singh and partly GAURAV SOROT 2023.01.18 10:25 I attest to the accuracy and authenticity of this order, judgment and documents.

( 2 ) CRM-M-54927-2022 (O&M) examined PW1-Amrik Singh and thereafter complainant invoked provisions of Section 319 Cr.P.C. and resultantly both the petitioners are summoned as additional accused by the learned trial Court. On the last date of hearing the Coordinate Bench of this Court passed detailed order and granted interim bail to the petitioners with further directions to them to join proceedings before learned trial Court. Counsel for the petitioners apprised the Court that in compliance of aforesaid order of this Court the petitioners joined proceedings before the trial Court.

State counsel on instructions from SI Pargat Singh has admitted that in compliance of previous order the petitioners have joined the proceedings in the trial.

In view of the above, without commenting on the merits of the case, this Court is of the opinion that no purpose is going to be served even if the petitioners are subjected to custodial interrogation at this stage. Thus present petition is hereby allowed and order of interim bail dated 24.11.2022 is hereby made absolute. The petitioners should abide by the conditions envisaged under Section 438(2) Cr.P.C. further the petitioners are directed to appear in the trial Court on each and every date fixed in the trial.
