(ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure (for short 'the Cr.P.C.)' praying for grant of anticipatory bail in Complaint case bearing NACT No.655 of 2017, under Sections 138/142 of the Negotiable Instruments Act, 1881. This Court on 25.11.2019, while issuing notice of motion, had also directed that in the meanwhile, the petitioner shall join the RAJ KUMAR ARORA 2020.01.24 10:17 I attest to the accuracy and integrity of this document
CRM-M-49901-2019 (O&M) proceedings before the learned trial Court forthwith and will be admitted on interim bail till the next date of hearing on his furnishing adequate bail and surety bonds to its satisfaction.
Mr.Rajesh Bansal, Advocate, had put in appearance on behalf of respondent No.2 on 13.1.2020 and on the request of learned counsel appearing on behalf of the petitioner, the matter was adjourned for today.
Mr.Abhishek Chha, Advocate, appearing on behalf of Ms.Garima Sharma, learned counsel for the petitioner submits that he has no instructions from the petitioner and therefore, he is unable to assist the Court in this regard Learned State counsel, on instructions from SI Balbir Singh, submits that the petitioner was declared a proclaimed person about two years ago and learned counsel for respondent No.2 has specifically stated that in pursuance of the directions issued by this Court on 25.11.2019, the petitioner has not appeared before the learned trial Court to join the proceedings.
Considering the totality of the circumstances and the fact that the petitioner has not joined the proceedings before the learned trial Court, the present petition is dismissed.
