The present petition has been filed for directions to the respondent No.5 not to interfere in free plying of the vehicle of the petitioner.

Notice of motion to the respondents No.1 to 4 only. 3.

Since advance notice has already been served upon the State, Mr. Eklavya Darshi, Deputy Advocate General, Punjab, accepts notice on behalf of the respondents No.1 to 4 and waives service. 4.

The learned counsel for the petitioner submits that in 2023, the petitioner had taken loan for the purchase of vehicle bearing registration No. PB-65AU-4845, and that he has been paying the instalments regularly without any default. But due to unvoidable circumstances, he could not pay some instalments. As per petitioner, on 06.07.2025, when he was plying the aforementioned vehicle, the agents/musclemen of respondent No.5 DEEPAK KUMAR BHARDWAJ 2025.08.29 17:01 I attest to the accuracy and integrity of this document intercepted his vehicle and after taking some gratification, released the same.

The petitioner has alleged that he has filed representation dated 08.07.2025 (Annexure P3), before the respondent No.3-Senior Superintendent of Police, Rupnagar, but no action has been taken as yet on the above said representation. The learned counsel for the petitioner further submits that a direction for disposing of the representation dated 08.07.2025 (Annexure P3) be given to the concerned authorities and the instant writ petition be disposed of.

Keeping in view the aforesaid facts, the present writ petition is hereby disposed of with a direction to the respondent No.3-Senior Superintendent of Police, Rupnagar, to pass a speaking order and decide the representation dated dated 08.07.2025 (Annexure P3), on its own merits, as per law, within a period of 15 days from the date of receipt of a copy of this order.

It is, however, made clear that no finding with regard to merits of the allegations is being recorded vide instant order, and the police authorities shall be at liberty to take an independent decision with regard to contents of the representation.
