(ORAL) CM-18999-CWP-2018 Present application has been filed on behalf of applicantsrespondents to place on record the written statement alongwith copy of office order dated 13.01.2010 as Annexure R-1. In view of the averments made in the application, the same is allowed. Written statement alongwith copy of office order dated 13.01.2010 (Annexure R-1) are taken on record, subject to all just exceptions.

CM stands allowed.

-2In the present writ petition, the prayer has been made by the petitioners for stepping up of their pay at par with their junior for the grant of the ACP with all consequential benefits. In respect of the prayer, petitioners are relying upon order of this Court passed in CWP No.25750 of 2013 titled 'Rajbir Singh Vs. Uttar Haryana Bijli Vitran Nigam Limited and others', decided on 08.01.2015 (Annexure P-16) and order passed in CWP No.6829 of 2013 titled 'Satya Narain Sharma Vs. Uttar Haryana Bijli Vitran Nigam and another', decided on 24.04.2015 (Annexure P-17). Counsel for the petitioners states that at this stage, the petitioners will be satisfied in case a time bound direction is issued to the respondents to decide their legal notice dated 13.07.

2015 (Annexure P-12), which they have served with the respondents in respect of the relief, which is claimed in the present writ petition. Counsel for the respondents states that he has no objection with regard to the prayer made by counsel for the petitioners for passing the appropriate orders on the legal notice dated 13.07.2015 (Annexure P12), submitted by the petitioners, in a time bound manner. In view of the above, present writ petition is disposed of with the directions to the respondents to pass the appropriate orders on the legal notice dated 13.07.2015 (P-12) served by the petitioners, within a period of two months from the date of receipt of certified copy of this order.

-3mentioned decisions rendered by this Court (Annexures P-16 and P-17), which are being relied by the petitioners, while passing the appropriate orders.

In case after passing of the order and deciding the said legal notice, it is found that the petitioners are entitled for the relief as prayed by them, the same shall also be released to them within a period of next two months.

It is made clear that this Court does not express any opinion on the merits of the case and the claim being made in the present writ petition or in the legal notice.
