The petitioner is seeking the concession of anticipatory bail under Section under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of anticipatory bail in case FIR No.85 dated 19.05.2024 under Sections 324, 323, 34 of the Indian Penal Code, 1860 (Section 326 of IPC added later on), registered at Police Station City Muktsar, District Sri Muktsar Sahib.

On 04.10.2024, while noticing the following submissions made by the learned counsel for the petitioner, a Coordinate Bench of this Court had granted the concession of interim bail to the petitioner and asked him to join investigation:- "It is argued that petitioner has been falsely implicated in the present FIR. Simple injury with kirpan was attributed to present petitioner. He is ready to join the investigation and cooperate with Investigating Agency"

Learned counsel for the petitioner submits that in compliance of order dated 04.10.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from SI Balraj Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 04.10.2024 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
