NIDHI GUPTA, J. (ORAL) Prayer in this first petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 72 dated 03.09.2013 registered under Section 306 IPC at Police Station Sadar Banga, District Shaheed Bhagat Singh Nagar.

Learned counsel for the State has filed custody certificate dated 17.08.2023, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 08 months and 28 days.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage.
