*** Mr. Ashish Pundir, Advocate has appeared on behalf of the complainant by filing vakalatnama, which be taken on record. Complainant Gajjan Singh is present in the Court. This petition for regular bail has been filed by petitioner Surjit Singh, an accused in F.I.R. No. 75 dated 29.7.2019 registered with Police Station Ramdas, District Amritsar Rural for offences under Sections 420,467,468,471,120-B IPC.
Briefly stated the facts of the case as per prosecution story are that petitioner accused Surjit Singh had received a sum of Rs.3 lacs from complainant Gajjan Singh by giving him allurement of getting him appointed in Jail Police Amritsar. Sandeep Singh was also his accomplice in doing so. They had taken the money in the name of one Gurjit Singh Aujala, Member of Parliament from Amritsar but the complainant was neither got appointed in the Jail Police and nor his money was returned.

CRM-M-48778 of 2019 was registered. Accused was arrested in this case on 18.8.2019 and he is in judicial custody till today. The challan against him has been filed and trial is going on. During the trial complainant has not supported the prosecution story and has rather been declared a hostile witness. Similar position is there with regard to PW2 Kashmir Singh, PW 3 Gurpreet Singh and PW4 Jaswinder Singh. Copies of statements of such PWs have been placed on record by learned counsel for the petitioner.
I have heard learned counsel for the petitioner, learned counsel for the complainant and learned State counsel besides going through the record. Learned counsel for the petitioner has contended that the matter has since been compromised between the parties. The complainant had been asked to appear in the Court and he has put in appearance along with counsel. On being enquired, he states that the matter has been compromised between him and the petitioner and does not oppose the request for bail. Keeping in view the facts and circumstances of the case, the petition is accepted. Petitioner Surjit Singh is ordered to be released on bail on his furnishing bail bond and surety bond to the satisfaction of the learned trial Court/CJM/Duty Magistrate, Amritsar.
