SUVIR SEHGAL, J. (Oral) The petitioner is seeking regular bail in FIR No.214 dated 10.12.2007 under Sections 22/61/85 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station C-Division, District Amritsar.

Learned counsel for the petitioner has submitted that contraband recovered from the petitioner is non-commercial and he has been in custody since 20.03.2019. He further submits that no doubt, FIR is of the year 2007 but since the petitioner had been declared as a Proclaimed Offender on 22.03.2013 and he was arrested on 20.03.2019, the case remained pending.

On instructions from ASI Nirmal Singh, learned State counsel has not disputed the factual assertion made by counsel for the petitioner. He has further submitted that one of the accused Raj Kaur has already been SAVITA KADIAN 2020.01.14 13:02 I attest to the accuracy and integrity of this document High Court Chandigarh

CRM-M-47861 of 2019 {2} acquitted on 07.06.2017 and other accused Talveer Kaur has been declared as a Proclaimed Offender. No other case is pending against the petitioner. Heard.

The petitioner has been behind bars for the last more than 09 months. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars any further. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
