This is a petition under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.131 dated 13.08.2022, under Sections 399, 402 IPC and Sections 21, 25, 54, 59 of the Arms Act, registered at Police Station PAU, District Ludhiana.

It is the case of the prosecution that SI Balwinder Singh along with other police officials was present at Y-Block, Hambran Road for patrolling. A secret information was received that the petitioner and others have formed a gang. They were having deadly weapons. They were sitting at cremation ground with illegal deadly weapons and were planning to commit a big crime/dacoity.

The FIR was got registered. The petitioners and others were apprehended.

Learned counsel for the petitioner states that false case has been planted against the petitioner. The challan has already been presented. The petitioner is in custody since 14.08.2022. The co-accused Ravi Sahota, MONIKA 2023.03.02 14:40 I attest to the accuracy and integrity of this document

Rupinder Singh @ Rupinterjit Singh and Kuldeep Singh have already been released on bail.

Learned State Counsel, on the other hand, while opposing the prayer made by learned counsel for the petitioner, fairly concedes that the petitioner is in custody since 14.08.2022 and three co-accused of the petitioner have already been released on bail. He has further apprised this Court that four other cases are pending against the petitioner. Heard.

Keeping in view the facts that the petitioner is in custody since 14.08.2022; the challan has been presented; co-accused of the petitioner have already been released on bail and the completion of trial will also take a long time, no useful purpose would be served by keeping the petitioner behind bars for a long period.

Accordingly, without commenting upon the merits of the case, the present petition is allowed and the petitioner is directed to be released on regular bail, on his furnishing bail bonds/surety bonds, to the satisfaction of learned Trial Court/Duty Magistrate, Ludhiana.
