**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present case, the petitioner is seeking the step up of his basic pay equivalent to his junior.

Petitioner has retired from the service on 31.03.2007 and during his service career, he had not raised even a single grouse with regard to less pay, being paid to him, as compared to his junior, with whom he seeks to step up his basic pay. No justifiable reason has been given by the petitioner to approach this Court after a period of eleven years after his retirement.

Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served respondents with a legal notice on 12.01.2018 (Annexure P-3), which is still pending consideration with the respondents and the NARESH KUMAR 2018.12.20 09:49 I attest to the accuracy and integrity of this document Chandigarh

CWP-32211-2018 -2petitioner will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 12.01.2018 (Annexure P-3) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

It is made clear that in case the petitioner is found entitled for the said relief, the same shall be given notionally and no arrears shall be given to him.

Present writ petition stands disposed of.
