*** Amol Rattan Singh, J. (Oral) By this petition, filed under the provisions of Section 438 of the Cr.P.C., the petitioners seek the concession of 'anticipatory bail'. Pursuant to the order dated 13.11.2019, learned State counsel submits that he having seen the video recording as is available on the mobile phone of ASI Rajinder Singh, he has also determined from the said police official that the petitioners, i.e. Baljeet Singh and Malkit Singh, though were seen running inside the Police Station, no overt act of actually attacking any policeman can be attributed to them. That being so, the present petition is allowed, with the SATYAWAN 2019.12.25 17:08 I attest to the accuracy and integrity of this document

Crl. Misc. No.M-47575 of 2019 petitioners directed to join investigation and in case they are sought to be arrested, they would be admitted to bail, on their furnishing adequate bail and surety bonds to the satisfaction of the arresting officer/Illaqa Magistrate. They shall abide by the conditions stipulated in Section 438(2) of the Cr.P.C.

If the arresting officer does not join the petitioners in investigation, they would appear before the learned Illaqa Magistrate immediately, who would then summon the arresting officer and direct him to join them in investigation.
