The present petition has been filed for directing respondent No.2 to release gratuity and pension wrongly withheld without any reason or justification alongwith interest.

Learned counsel submits that the petitioner had not been released retiral benefits, for which purpose, the present petition has been preferred. However, during pendency of the petition, the same has been released albeit with delay. He thus, at this stage, on instructions, submits that the petitioner would be satisfied, in case a time bound direction be given to the respondents to decide his claim of the interest by granting him an opportunity of hearing. 3.
Learned State counsel has no objection to the limited prayer made. 4.
In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to the respondents to consider and decide the claim of the petitioner, within a period of 6 months, which this Court has no reason to believe the authorities would not address in a just, fair MOHIT 2024.05.03 15:49 I attest to the accuracy and authenticity of this order/judgment

CWP-23840-2023 (O&M) -2and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith.
