The defendant No.3, in a suit for grant of prohibitory and mandatory injunction restraining the defendants from transferring the petition, assails the order passed by the learned trial Court refusing to reject the plaint at the threshold under Order VII Rule 11 CPC. 2.

The learned counsel representing the petitioner contends that the defendant No.2 and 3 have wrongly been impleaded as party. 3.

Order VII Rule 11 CPC specifies the grounds on which the plaint can be rejected. If the petitioner claims that it has been wrongly impleaded as a party, the remedy available is under Order I CPC. Hence, the present revision petition is dismissed.
