The petitioner has filed this petition seeking grant of regular bail in a case registered against him vide FIR No.186 dated 24.9.2018 under Section 22 of NDPS Act at Police Station Canal Colony, District Bathinda. 2.

It is the case of prosecution that 1180 tablets containing 'Tramadol Hydrochloride' were recovered from possession of the petitioner. 3.

The petitioner has submitted that in the present case only 10 tablets out of the recovered 1180 tablets were sent for chemical examination and that the same has been held to be not proper in view of law laid down in Gaunter Edwin Kircher vs. State of Goa, Secretariat Panji, Goa, 1993 AIR (SC) 1456; State of Punjab vs. Dharam Singh, 2010(3) RCR (Criminal) 94; Gurjant Singh vs. State of Punjab, CRM-M-13309-2019, DOD 1.4.2019 and Harjinder Kaur vs. State of Punjab, CRM-M-138262019, DOD 22.4.2019. Opposing the petition, learned State counsel has submitted that as on date 7 PWs out of cited 11 PWs have already been examined. 5.

Having regard to the facts and circumstances of the case and the fact that it is a case of recovery of contraband which would fall within quantitative limits of "commercial quantity" and the fact that a substantial number of witnesses have been examined, this Court does not find any ground for grant of bail. The petition, as such, is sans merit and is hereby dismissed. 6.
