The present intra-court appeal, under Clause X of the Letters Patent, has been filed against the judgment dated 27.07.2023, vide which the civil writ petition preferred by the appellant came to be dismissed. 2.

The claim of the respondent for reimbursement of medical bills on account of hip replacement surgery from Government Medical College and Hospital, Sector 32, Chandigarh, verified by its Medical Superintendent, as an indoor patient has been allowed by the learned Single Judge by placing reliance on the judgment dated 20.02.2017 passed by a Division Bench of this Court in CWP No.22833 of 2015, titled as Ayoudhia Prasad Duggal vs. CAT, Chandigarh and others, against which, the SLP filed by Union of India, also stands dismissed on 24.11.2017. It was not the case, wherein the respondent had taken the medical treatment from a private hospital. Hence, the appellant-State cannot restrict the amount of reimbursement.
