RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for issuance of directions to respondents No.1 to 4 to restrain respondent No.5 from carrying illegal construction on plot Nos.58, 59, 60 and 61 located in Hill View Enclave Peer Muchalla Road Dhakoli NAC Zirakpur, Mohali, Punjab, which measure 225 sq. yards each by fragmenting them into smaller plots. Further prayer has been made for directing respondent No.4 not to register sale deeds by fragmenting plot nos.58, 59, 60 and 61 located in Hill View Enclave Peer Muchalla Road Dhakoli NAC Zirakpur, Mohali, Punjab into smaller plots.

CWP-23795-2023 -2Learned senior counsel appearing for respondent No.3 submits that the colony, where the petitioners are residing, came into being before formation of respondent No.3, i.e. Notified Area Committee, Zirakpur. He further submits that earlier also one of the petitioners, i.e. petitioner No.3, had approached this Court by way of filing CWP-15010-2008 and the same was disposed of by this Court vide order dated 29.04.2010. The Executive Officer, who is present in Court, apprised the Court that this Colony is not regularised so far. However, he further submits that if the petitioners file a representation for redressal of their grievances, they would be heard in person and their representation would be decided expeditiously in accordance with law.

Learned counsel for the petitioners has submitted that the petitioners have already filed a representation, dated 21.12.2022, Annexure P-1, and the same has not been decided till date. After hearing counsel for the parties and in view of the facts and circumstances of this case, the present petition is disposed of with a direction to respondent No.3, the Executive Officer, Notified Area Committee, Zirakpur, Mohali, to decide the representation, dated 21.12.2022, Annexure P-1, in accordance with law expeditiously preferably within one month from today.

Status quo would be maintained till the representation is decided by the respondents.
