Present petition has been filed for quashing the impugned transfer order dated 11.08.2023 (Annexure P-1) whereby the petitioner has been transferred from Civil Hospital Narwana, Jind to Civil Hospital, Bhiwani.

Learned counsel for the petitioner submits that the petitioner has been transferred by ignoring the fact that the claim of the petitioner to remain in the same district is due to the reason that the wife of the petitioner has been posted in the same District.

Learned counsel for the petitioner further submits that as there are posts lying vacant in the said district, the petitioner intends to approach the respondents that he can be adjusted on any of one the said vacant post. 3.

Mr. Saurabh Mohunta, DAG, Haryana, who is present in Court, accepts notice on behalf of State of Haryana-respondents. 5.

Learned State counsel submits that in case any representation is received form the petitioner giving the details of the vacant posts against RIYA 2023.10.20 15:02 I attest to the accuracy and integrity of this document

CWP No. 23939-2023 -22023:PHHC:136566 which the petitioner can be accommodated, the said representation will be decided by the competent authority within a period of eight weeks of the receipt of certified copy of this order by passing an appropriate speaking order and in case, after the decision, the petitioner is found entitled for any benefit, the same will be extended to him within a further period of four weeks.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed, any further, with liberty as prayed for so as to approach the respondents.
