Learned counsel for the petitioner inter alia contends that the petitioner is innocent and has been falsely implicated in this case on the basis of disclosure statement made by co-accused Jatinder @ Kala. He submits that even the perusal of the disclosure statement would not reveal anything directly connecting the petitioner with the alleged offence. He further contends that the recovery has already been effected and the petitioner has no role in the alleged transaction.

Per contra, learned State counsel while referring to the status report has reiterated that the petitioner has been nominated on the basis of disclosure statement of coaccused Jatinder @ Kala, which has been placed on record as Annexure R-1.

In these circumstances, without commenting on the merits of the case, the petitioner is hereby directed to join investigation within seven days from today and co-operate in the same. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 482(2) BNSS. List on 21.11.2024."
