***** ARCHANA PURI, J. (Oral) As observed in the previous order dated 17.12.2024, despite service, the respondent did not make appearance on that date. Even today, none has made appearance on his behalf. As such, the respondent is proceeded against ex parte.

It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 21.03.2018. One son born from the said wedlock, who is about 6 years old, is in the care and custody



of the applicant. The said son is studying in the school at Bathinda. On account of the matrimonial discord, the applicant has filed the petition under Section 12 of the Protection of Women from Domestic Violence Act i.e. COMA/1611/2023 and the same is still at the appearance stage and is fixed for munadi. Besides the same, the applicant has got lodged an FIR bearing No.60 dated 21.09.2023, under Section 498-A IPC, at Women Police Station, District Bathinda, which is pending investigation. The applicant has no source of earning and is totally dependent upon her parental family, which is also not much affluent and thus, she has filed the maintenance petition i.e. MNT-125/135/2024. Therein also, the respondent is evading service and the case is fixed for appearance through munadi.

In the given circumstances, it is submitted that it is difficult for the applicant to commute a distance of about 50 kilometres, from the place of her residence, more particularly, while she is not having any source of earning and also taking care of the minor son.
