(ORAL) In the present case, the petitioner, who is widow of late Sh.Daya Chand, has approached this Court for the release of the pension for which her husband was entitled for after his retirement on 31.12.2000. It has been averred in the petition that after the retirement of husband of the petitioner, on one pretext or the other, the pension has not been released and without enjoying the fruits of the service, which her husband has rendered, he unfortunately died on 30.03.2015. Even till today, neither the pension has been released for which the husband of the petitioner was entitled for after retirement nor the family pension has been released for which the petitioner is entitled for after the death of her husband.

Counsel for the petitioner further states that for the release of the pension as well as the family pension, the petitioner has submitted a NARESH KUMAR 2018.12.18 15:31 I attest to the accuracy and integrity of this document Chandigarh

CWP-31700-2018 -2representation dated 17.05.2018 (Annexure P-6), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to pass an appropriate order to decide the claim of the petitioner for the grant of pension to the husband of the petitioner after he retired on 31.12.2000 till he died in the year 2015 and thereafter, the grant of family pension to the petitioner.

In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the representation dated 17.05.2018 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of next three months.

Present writ petition stands disposed of.
