(Oral) The prayer in the present petition under Section 528 of BNSS, 2023 is for quashing of the FIR No.789 dated 24.11.2021 (Annexure P-1) under Sections 406, 420, 120-B and 34 of IPC, 1860 registered at Police Station HTM Hisar, District Hisar, Haryana (offence under Sections 34 and 120-B of IPC were deleted later on) and all other subsequent proceedings arising thereof, against the petitioner only. 2.
Mr. DPS Bajwa, Advocate has appeared and filed his vakalatnama on behalf of the respondent No.2 today in the Court and the same is taken on record.

Brief allegations in the FIR are that the complainant, namely, Seema Chahal had parted with an amount of Rs.14,00,000/-
which she paid to the petitioner-Ankit Sharma, the Sales Manager of Rajdarbar Buildcon Private Limited. Despite making the payment of the said amount, the apartment was not handed over to her. 4.
The learned counsel for the petitioner contends that after the FIR had been registered, Seema Chahal got recorded her supplementary statement to the effect that she did not wish to proceed against the Directors and other officials of the Rajdarbar Buildcon Private Limited, as they had adjusted the amount of Rs.14,00,000/- and leaving a balance of Rs.57,50,000/-, a plot had been given to her. Therefore, the Directors, namely, Vasu Garg and Piyush Goyal, were found innocent. Once a settlement has arrived at with the main accused, the FIR against the petitioners, who is merely a Sales Manager ought to be quashed qua him.

The learned State Counsel and counsel for the respondent No.2 have not disputed the factual position that on the basis of the supplementary statement, the Directors Vasu Garg and Piyush Goyal have been found innocent.

I have heard learned counsels for the parties. 7.
Admittedly, a settlement has been arrived at between the complainant on the one hand and the Directors on the other, namely Vasu Garg and Piyush Goyal. The petitioner was merely a Sales Manager. Therefore, no useful purpose would be served by allowing the instant proceedings emanating out of FIR No.789 dated 24.11.2021 (Annexure P-1) under Sections 406, 420, 120-B and 34 of IPC, 1860, to
continue against the petitioner.

In view of the above, FIR No.789 dated 24.11.2021 (Annexure P-1) under Sections 406, 420, 120-B and 34 of IPC, 1860 registered at Police Station HTM Hisar, District Hisar, Haryana (offence under Sections 34 and 120-B of IPC were deleted later on) and all other subsequent proceedings arising therefrom stands quashed qua the petitioner only.

All the pending miscellaneous applications, if any, stand disposed of.
