H. S. Madaan, J. (Oral) This application for pre-arrest bail has been filed by Ashu Kumar, an accused in FIR No. 587, dated 10.9.2019, for offence under Section 21 of the NDPS Act, 1985, registered at Police Station Sirsa city, Sirsa.

Briefly stated, the prosecution story is that on 10.9.2019, a police party from Police Station Sirsa City, Sirsa, had apprehended accused Sunny s/o Pala Ram resident of Balmiki chowk, Sirsa and recovered 20 grams of Heroin from him. He was interrogated, during the course of which he stated that he had purchased the Heroin from Ashu Kumar s/o Surinder Kumar resident of Balmiki Chowk, Sirsa - BANITA CHUGH 2020.01.09 15:54 I am the author of this document

CRM-M-47649 of 2019 -2the present petitioner. Such petitioner had preferred an application for pre-arrest bail before Additional Sessions Judge, Sirsa, but the same was declined, vide order dated 1.11.2019. As such he has approached this Court by way of filing similar petition, notice of which was given to the State.

I have heard Learned counsel for the petitioner and learned State counsel, besides going through the record. Though as per order passed by this Court, the petitioner has joined the investigation, but I find that keeping in view the facts and circumstances of the case, his custodial interrogation is necessary for complete and effective investigation of the case and to complete the link of supply of the contraband. Drug addiction in the area is showing an alarming increase and drug peddlers need to be dealt with sternly. Therefore, I do not find it a fit case to grant anticipatory bail to the petitioner.

Accordingly, the petition stands dismissed.
