Prayer in this writ petition is for directing the official respondents to not interfere in the working of petitioner's work of Hadda Rodi which he and prior to him, his father is stated to be carrying out since 1974, with a further prayer for demarcation of the site and to get the same vacated from the encroachers.
It is submitted that a complaint was filed on behalf of Guru Nanak Dev University College, village Tehang, Tehsil Phillaur (which is incidentally not arrayed as party to this writ petition) to the effect that foul smell is emanating from the site of Hadda Rodi, which is causing difficulty to the staff and students of the said college. Petitioner received notice dated 15.09.2022 from the Block Development and Panchayat Officer, Phillaur. CWP No.27593 of 2022 [2] his reply dated 19.09.2022 in this regard. Present writ petition has now been filed with the prayer as above.
We have heard learned counsel for the petitioner and have gone through the file.
It is not denied that the matter is pending final adjudication before the authorities pursuant to issuance of notice dated 15.09.2022 to the petitioner wherein it is also mentioned that the petitioner had given an assurance not to operate Hadda Rodi.
Keeping in view the facts and circumstances, we do not deem it appropriate, at this stage to enter adjudication of the controversy sought to be raised in this writ petition. Writ petition is undoubtedly premature and is disposed of accordingly. Needless to say, petitioner is at liberty to pursue the matter before the competent authority/authorities.
