The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to issue him passport.

As per averments made in para No. 3 of the writ petition, challan has already been presented and charges stand framed against the petitioner in FIR No. 6 dated 23.01.2022, under Sections 323, 342, 506, 148, 149 and 365 of IPC, registered at Police Station Nangal, District Roopnagar. The petitioner has preferred application seeking passport before passport authority at Shimla.

As per averments in the petition, charges stand framed and as per Notification No. 570 dated 25.08.1993 issued by the Central Government, the petitioner is supposed to approach trial court and further PARAMJIT KAUR SAINI 2023.10.20 17:53 I attest to the accuracy and authenticity of this order/judgment

CWP No.24122 of 2023 -2- 2023:PHHC:137043 the petitioner has filed application before passport authority, Shimla and this Court has no jurisdiction to direct the said authority to issue passport. Faced with this, learned counsel for the petitioner seeks permission to withdraw with liberty to avail remedy as permissible by law. 5.
