RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed praying for setting aside the impugned judgment dated 29.09.2022 passed by the Court of learned CJM, Moga and judgement dated 07.11.2022 passed by court of learned Additional Sessions Judge, Moga, with a further prayer to issue direction to the official respondents No.2 and 3 not to arrest Daljit Singh, i.e. brother of the petitioner in case FIR No.111, dated 28.05.2022, under Sections 376, 323 and 506 IPC, registered at Police Station City Moga, District Moga. Counsel for the petitioner submits that petitioner is brother of accused Daljit Singh, who is not well and for that reason he has approached this Court in place of his brother.

However, this Court is of the opinion that petitioner is not legally entitled to file the present petition on behalf of the accused and hence, the present petition is dismissed being not maintainable. December 01, 2022 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
