The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.231 dated 9.6.2013 registered for the offence under Section 135 of the Electricity Act, 2003 at Police Station Anti Power Theft, Verka Amritsar, District Amritsar. I have heard learned counsel for the petitioner and have gone through the record.
From the perusal of record, I find that the present FIR bearing No.231 dated 9.6.2013 has been registered against the petitioner. The learned Additional Sessions Judge, Gurdaspur had given the benefit of interim anticipatory bail which was subject to the petitioner depositing of 1/3rd amount of the fine but the petitioner has not deposited the 1/3rd amount in compliance with the order dated 31.7.2013 and his bail application was HARPAL SINGH PARMAR 2018.12.18 14:52 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-55622 of 2018 [2] dismissed for non-compliance of the order.
A perusal of the record shows that the petitioner has not complied with the said order till date. 1/3rd amount of fine has not been deposited so far by the petitioner even after the passage of 51⁄2 years. The petitioner has again filed this petition for grant of anticipatory bail to the him. A perusal of the record shows that the conduct of the petitioner disentitles him for the grant of benefit of discretionary relief of anticipatory bail. No cogent ground has been given as to why this amount has not been deposited even before filing of this petition. No ground is made out for grant of anticipatory bail.
Therefore, finding no merit in this petition, the same is dismissed.
