CRM-M-51613-2019 The petitioner through instant petition under Section 439(2) Cr.P.C. is seeking cancellation of anticipatory bail granted by Sessions Judge, Jhajjar in FIR No.284 dated 29.06.2019 registered at Police Station Firozepur Jhirka, under Sections 346, 363, 366-A, 120-B of IPC. Learned counsel for the petitioner, at the outset, concedes the fact that police, after completing the investigation, has filed challan, charges stand framed and examination of prosecution witnesses is about to complete.

CRM-M-51613-2019 (O&M) -2Learned State counsel submits that there is no evidence on record disclosing misuse of anticipatory bail granted by the respondent. She further submits that it is a factually correct that the trial is at fag end, thus, there seems no reason to cancel anticipatory bail which was granted vide order dated 26.09.2019.

In view of statements of counsel for the parties that challan stands presented and respondent No, 2 has not misused the concession of anticipatory bail, the present petition is devoid of merit and deserves to be dismissed. Accordingly, the petition is dismissed.
