Jagsir Singh Alias Jaggi v. State Of Punjab

Prayer in this petition is for grant of anticipatory bail under Section 438 Cr.P.C in case FIR No.75 dated 02.09.2023 registered under Sections 457, 380, 411 of the IPC registered at Police Station Hathur, District Ludhiana. As per allegations, on the night of 31.08.2023 some unknown persons committed theft of two gas cylinders and amplifier along with the microphone. On the complaint of Gurmail Singh, FIR was registered.

Learned counsel contends that petitioner is not named in the FIR; and that FIR has been lodged after two days of theft and later on the complainant told that he had come to know that petitioner was one of the thieves. Learned counsel further contends that no source of information has been given by the complainant as to how he came to know that petitioner was the thief.

In the meantime, in case of arrest, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer/Investigating Officer. However, it is directed that the petitioner shall join the investigation as and when so required by the Investigating Officer. He shall not contact any person associated with the case to dissuade him from the investigation in any manner whatsoever and nor shall leave the country without prior permission of the Court. He shall further comply with the conditions stipulated in Section 438(2) Cr.P.C.
