******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No. 178 dated 30.09.2019 registered for the offences punishable under Sections 420, 467, 468, 471, 120-B of Indian Penal Code (for short IPC) at Police Station Sadar Kapurthala, District Kapurthala. The petitioner was in custody in a complaint case titled as "Indian Overseas Bank Vs. Amandeep Singh" and was ordered to be released on bail. It was found that his surety had furnished forged jamabandi in support of his contention about the property owned by him while furnishing the surety bond for release of the petitioner. The present FIR was registered on the complaint by concerned Judicial Magistrate Ist Class, Kapurthala, and the petitioner was arrested on JYOTI 2019.12.03 11:43 I attest to the accuracy and integrity of this document

CRM-M-47974-2019 -205.10.2019. He is in custody since then. The challan in this case has not been presented so far.

Keeping in view the above facts and that presentation of challan, conclusion of trial will take considerable long time, this petition is allowed. Petitioner-Amandeep Singh is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of concerned Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- a. The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

b. In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh.

c. He shall not leave the country without the prior permission of the Court.

d. The surety bond furnished by the petitioner will be got verified before he is released on bail, even if, he takes some time to get it verified.
