The prayer in the present petition filed under Articles 226/227 of the Constitution of India is for issuance of a writ in the nature of mandamus directing respondents to ensure the protection of life and liberty of the petitioner and his family members at the hands of accused named in the FIR No.45 dated 22.08.2021 (Annexure P-1) registered under Sections 307, 365, 342, 323, 506, 148 and 149 of IPC, 1860, (later on Section 307 IPC deleted and 302 IPC added) at Police Station Mehal Kalan, District Barnala as the accused are pressurizing and threatening the petitioner not to give evidence against them. 2.

On 15.09.2025, the following order was passed:- "The learned counsel for the State on instructions from ASI Karamjit Singh submits that the petitioner shall be provided adequate security to enable him to depose in FIR No.45 dated 22.08.2021 KUSUM 2026.03.12 11:20 I attest to the accuracy and integrity of this document PHHC Chandigarh

CRWP-9340-2025 -2under Sections 307, 365, 342, 323, 506, 148 and 149 IPC (later on Section 307 IPC deleted and 302 IPC added) registered at Police Station Mehal Kalan, District Barnala.

On request, adjourned to 16.10.2025."

The learned counsel for the petitioner contends that during the pendency of the present petition, the statement of the petitioner has been recorded as PW-2 and therefore, he now wishes to withdraw the instant petition.
