Learned counsel for the parties are ad idem that the impugned order in the present appeal be set aside and the learned Single Judge to decide the matter afresh on merits.

In view of above, the appeal is disposed of and the matter is remanded back to the learned Single Judge to be decided the matter afresh on merits, after examining the termination order, appellate order and the review order on merits.
