Criminal Misc. Application bearing No.CRM-42037-2025, under Section 528 of BNSS, has been filed seeking preponement of the date of hearing in the main case, i.e. CRM-M-48010-2025, which is listed for 09.12.2025.

Counsel for the applicant/petitioner submits that applicant/petitioner seeks preponement of the date of hearing in the main case, as he intends to withdraw the same, in order to file a second bail application before the Court below.
It is further submitted that the earlier bail petition was filed before the Court of Sessions at a stage when investigation was still in progress. However, investigation has now been completed, and final report has already been submitted in the present case. CRM-M-48010-2025 (O&M) -2applicant/petitioner wishes to withdraw the present petition to enable him to approach the trial Court, afresh.

Further submits that present petition is the second regular bail application and petitioner was found in possession of 900 tablets containing Alprazolam salt, and total weight of the contraband comes out to be 73.8 grams, which is below the commercial quantity threshold of 100 grams.

Mr. Neeraj Madaan, Sr. DAG, Punjab, who is present in Court, accepts notice on behalf of the non-applicant/respondent - State and pleads no objection to the prayer made therein. 6.
Considering the submissions addressed by counsel for the respective parties, date of hearing in the main case is preponed from 09.12.2025 to today itself, i.e., 04.11.2025, and the same is taken on board for disposal.

In view of the statement made by counsel for the applicant/petitioner, present petition, i.e. CRM-M-48010-2025 stands dismissed as withdrawn, with liberty to file an application seeking bail before the trial Court.
