State of Haryana and others ... Respondents
CORAM:
HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. Kamal Deep Sehra, Advocate for the petitioner.
**** AMIT RAWAL, J. (ORAL) Notice of motion.
On asking of the Court, Mr. Hitesh Pandit, Addl. A.G., Haryana, who is present in Court, accepts notice on behalf of the respondent(s)/State.
Grievance of petitioner, in the present writ petition, is that against the orders dated 13.11.2018 (Annexure P-2) and 17.09.2015 (Annexure P-1), petitioner has preferred a revision petition, as per Punjab Police Rules, as applicable to Haryana (hereinafter called 'the Rules'), before the Director General of Police, Haryana/respondent No.2, but no action has been taken so far.
Without going into the merits and demerits of the claim of the petitioner, I am of the view that once the petitioner has already availed the remedy, his grievance/claim cannot remain unaddressed and there has to be adjudication by the Authorities. Accordingly, I deem it appropriate to
YOGESH SHARMA 2019.11.26 12:53 I attest to the accuracy and integrity of this document CWP-32594-2019 (O&M) dispose of the present writ petition with a direction to respondent No.2 to decide the revision petition after affording the opportunity of hearing to the petitioner, within a period of four months from the date of receipt of certified copy of this order, in accordance with law, failing which, respondent No2 shall be liable to pay costs of `25,000/- to petitioner. This condition of imposing costs is only to prevent petitioner to run from pillar to post and avail remedy of contempt in case of noncompliance of directions issued by this Court. The writ petition stands disposed of with the above direction. ( AMIT RAWAL ) JUDGE 08.11.2019 Yogesh Sharma Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
