1. The petitioner herein is the successful purchaser of a property which was put up for auction by Punjab National Bank, Bathinda under the provisions of SARFAESI Act as the owner of the property had defaulted in repayment of the loan.

2. Pursuant to deposit of the entire payment, a sale certificate dated 10.3.2021 (Annexure P-2) was issued in favour of the petitioner. It has been submitted that in accordance with provisions of Section 17(2) (XII) of the Registration Act, any such certificate of sale granted in favour of the purchaser in respect of any property sold in public auction by a civil or revenue officer would be exempted from stamp duty and registration charges. It has been submitted that although the petitioner had moved an appropriate application dated MOHAN SINGH 2023.10.20 17:40 I attest to the accuracy and authenticity of this order/judgment

CWP-24037-2023 (O&M) ( 2 ) 2023:PHHC:137121 31.5.2023 (Annexure P-4) to the Sub Registrar, Nathana/Bathinda for exemption from payment of stamp duty and registration charges, but the same has not been decided so far.

Having heard the learned counsel for the petitioner, but without commenting anything as regards the averments made in the petition, the same is disposed of with a direction to respondent No.2-The Sub Registrar, Tehsil Nathana, District Bathinda to consider and dispose of application dated 31.5.2023 (Annexure P-4) in accordance with law expeditiously, preferably within a period of 3 weeks from today.
