Mr. Amit Rana, Senior Deputy Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Prayer in the instant petition (second) is for concession of anticipatory bail to the petitioner in FIR No.141 dated 23.09.2023 under Sections 454, 380, 447, 506, 511 of the Indian Penal Code, 1860, registered at Police Station Dakha, Ludhiana. 2.

Vide order dated 22.01.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner submits that totally false allegations have been levelled against the petitioner that he trespassed into the plot of land owned by the complainant and thereafter committed theft. It has been submitted that the articles, which had been stolen, had already been recovered from the co-accused, who had since been extended the concession of bail." 3.

Learned State counsel, on instructions from SI Hamraj Singh Cheema, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 22.01.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
