NIDHI GUPTA, J.(Oral) Prayer in this petition filed by the petitioner is for setting aside the impugned order dated 02.8.2021 (Annexure P-3) passed by the Additional Civil Judge (Sr. Divn.), Amloh, whereby the defence of the petitioner/defendant has been struck off. Learned counsel for the petitioner contends that the petitioner/defendant could not file the written statement in the Civil Suit before the trial Court within a stipulated period of 90 days because of Covid-19 restrictions. He further submits that the petitioner would be satisfied in case one effective opportunity is granted to him to file the written statement before the trial Court in the Civil Suit.
