(Oral) At this stage, both the counsel for the appellant as well as the Insurance Company submit that amicable settlement has reached between the parties. The Insurance Company has agreed to pay an amount of Rs.4,00,000/-, over and above the amount awarded by the Tribunal, on account of death of Mohd. Aslam @ Aslam Khan, in a motor vehicular accident.

Heard.

Perusal of the impugned award reveals that the claim petition was filed by the widow, children as well as the parents of the deceased to seek compensation on account of death of Mohd. Aslam @ Aslam Khan, in a motor vehicular accident.

FAO-409-2020 (O&M) The Tribunal vide the impugned award had awarded compensation to the extent of Rs.19,97,800/-, however, the appellants had filed the FAO to seek enhancement of compensation. As observed aforesaid, since the Insurance Company had agreed to pay an amount of Rs.4,00,000/-, over and above the awarded amount, as such, the FAO is allowed and the Insurance Company is directed to pay the requisite amount of Rs.4,00,000/-, within a period of six weeks from today onwards.

In the eventuality of the Insurance Company not making the payment within the requisite period, the same shall be liable to pay penal interest @ 8 % per annum, till realization. (ARCHANA PURI) 11.05.2026 JUDGE Sonu Saini Whether speaking/reasoned :
