(ORAL) Petitioners have approached this Court claiming that they became entitled for the grant of arrears of pension in view of the judgment rendered by the Hon'ble Supreme Court of India in Civil Appeal No.1298 of 2018 titled as Darshan Singh and others Vs. State of Punjab and others decided on 30.01.2018 (Annexure P-2). Counsel for the petitioners contends that the similarly situated persons have already been extended the benefit of arrears of pension as well, whereas the same has not been released to the petitioners. It has been contended at the time of hearing that the petitioners have served legal notices to the respondents on 15.09.2018 and 28.09.2018 (Annexures P-3 and P-4), respectively, which are still pending consideration with the respondents. CWP-37615-2018 -2states that the petitioners will be satisfied in case, a time bound direction is issued to the respondents to decide the legal notices dated 15.09.2018 and 28.09.2018 (Annexures P-3 and P-4) respectively. Without commenting upon the merits of the case or about the entitlement of the petitioners for the relief which has been claimed by them in the legal notices dated 15.09.2018 and 28.09.2018 (Annexures P-3 and P-4) respectively, the present writ petition is disposed of with a direction to the respondents to decide the legal notices dated 15.09.2018 and 28.09.2018 (Annexures P-3 and P-4) respectively, within a period of three months from the receipt of copy of this order. In case, it is found that the petitioners are entitled to any monetary benefits after the decision of the legal notices, the same should also be paid to the petitioners within three months thereafter.
