Present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of bail pending trial to the petitioner in FIR No.90 dated 04.08.2023, under Section 306 of the Indian Penal Code, 1860, registered at Police Station Koomkalan, District Police Commissionerate, Ludhiana.

Learned counsel for the petitioner, on instructions, submits that co-accused-Rosy Kaur has already been granted the concession of bail pending trial by learned Additional Sessions Judge, Ludhiana (for short, 'ASJ'), vide order dated 01.04.2024 and as such, he wishes to withdraw present petition with liberty to take recourse to the remedy before learned trial Court, as per law.
