Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.425 dated 17.11.2017 under Sections 420, 467, 468, 471, 120-B IPC and Section 63 of the Copyright Act, registered at Police Station Sector-18, Gurugram. Notice of motion.
Mr.Sharad Kumar Yadav, DAG, Haryana, has put in appearance on behalf of the respondent-State and Mr.Pradeep Virk, Advocate has filed Power of Attorney and appeared on behalf of the complainant and contested the petition.
I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. As per allegations against the present petitioner, he is one of VINEET GULATI 2018.12.21 14:26 I attest to the accuracy and authenticity of this document Chandigarh the main accused along with Ombir Singh, being Director of the Company
CRM No.M-55988 of 2018 -2and they misused the copyright of the complainant i.e. Body Buildo, and holograms and other articles have been recovered in this case. They were selling these products through sasta bazaar.
The petitioner has been in custody since 11.10.2018. He is not required for investigation or interrogation purposes as he is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
