Instant petition has been filed inter-alia for issuance of a writ in the nature of mandamus directing the respondents No.2 and 3 to preserve CCTV footage of Police Station Kulgari from 23.09.2023 to 24.09.2023. A direction has been sought to respondents No.2 and 3 to conduct fair investigation in FIR No.120 dated 24.09.2023 lodged under Section 21 of the NDPS Act, Annexure P-1, from an independent agency as also to take action against the erring police officials.

By referring to the status report filed by way of an affidavit of Deputy Superintendent of Police (Rural), Ferozepur, State counsel submits that KAMAL SHARMA 2025.11.03 17:44 I attest to the accuracy and authenticity of this order/judgment.

CWP-24050-2023 -2investigation has been concluded and a cancellation report dated 21.12.2024 has been prepared. He has specific instructions received from SI, Nirmal Singh, Police Station Kulgari, Ferozepur, to state that the cancellation report would be presented before the competent Court within a fortnight. In so far as the direction to preserve CCTV footage is concerned, a perusal of the petition shows that a similar application was moved by the petitioner before the Special Court, which has been rejected vide order dated 11.10.2023, Annexure P-2. Petitioner has a remedy of assailing the said order and no direction can be passed in the instant writ petition.
