Appellant has come up before this Court by filing the present LeƩers Patent Appeal for seƫng aside the order dated 24.07.2025 passed by ld. Single Bench in CWP-153482021, whereby prayer of respondent No.1 was allowed. 2.

Counsel for the appellants submits that senior ciƟzen transferred property by way of Will in their favour and because of this reason they sought permission to avail legal remedy before the Civil Court, however, the Single Bench declined the same. Now for that limited purpose the appellant has come up before this Court. 3.

We have heard counsel for the parƟes. The ends of jusƟce would suffice if the order is read with the following modificaƟon. "The liberty is granted to appellant to avail legal remedy before Civil Court. This liberty shall be subject to law of limitaƟon and res judicata" 4.
