& ()* The instant petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS, 2023') seeking quashing of the complaint filed under Section 138 of the Negotiable Instruments Act, instituted against the petitioner by the respondent/complainant and the summoning order dated 14.11.2024 and to stay the proceedings before the trial Court during pendency of the present case as well as issue directions for the grant of regular bail with a reasonable surety amount to the petitioner in Criminal complaint no. NACT-444162022 instituted on 16.09.2022 titled as Monica Narang vs. M/s Shivangee Medicos under Section 138 of Negotiable Instruments Act. 2.

Learned counsel for the petitioner limited his prayer that petitioner is ready and willing to appear before the trial Court in pursuance SEEMA 2025.09.10 13:27 I attest to the accuracy and integrity of this document

 

 of order dated 28.05.2025 vide which bailable warrants were issued against the petitioner and sought direction to be issued to the trial Court to release him on bail on furnishing of bail bonds in terms of observation of this Court passed in CRM-M-4195-2025 decided on 27.01.2025 titled Saraswati Devi vs. Harvinder Singh Sodhi. After arguing at some length, he seeks permission to withdraw the present petition to raise all pleas before the learned trial Court at appropriate stage as raised herein. 3.

Permitted to do so.

Petition is dismissed as withdrawn, with liberty aforesaid.
