Prayer made in the present petition is for directing the respondents to grant recruitment/finalizing to the petitioner for the post of multipurpose health worker and setting aside the speaking order dated 20.05.2019.

Petitioner, admittedly applied under the category of SC R&O alongwith certificate to substantiate the said category, for which written examination was conducted wherein he scored 282 marks, regarding which in speaking order as also the reply, it has been stated that petitioner being lower in merit as the last selected candidate in the said category secured 396 marks, did not fall within the zone of consideration. However, learned counsel states that petitioner had submitted a representation on 26.07.2018, Annexure P-6, stating himself to be the son of Ex-serviceman but there is nothing shown even during the course of arguments that he at the initial stage ever approached the respondents with regard to the change in category as Lineal Descendent of Ex-serviceman, nor is it the case set up that any certificate to HAMANT 2025.03.06 13:37 I attest to the accuracy and integrity of this document

CWP-33149-2019 that effect was appended alongwith application and that as such it was merely a case of inadvertent selection of category or that in the admit card issued for written exam also, this category was not mentioned. It is apparent therefrom, that by way of afterthought that the petitioner having been found to be lower in merit in the category of SC R&O, has made up his claim. 3.

This Court in CWP-5046-2017 titled as Surinder Singh vs. State of Punjab dismissed the same on 01.05.2019, wherein the change of category was held to be impermissible, the selection process being over which stands upheld by the Division Bench in LPA-1117-2019. 4.

In view of the above, there is no merit in the present petition, which is hereby dismissed.
