The petitioner has filed the instant petition under Section 439 of the Cr.P.C. with a prayer to grant him interim bail in case FIR No.78 dated 29.09.2023 registered under Sections 20, 29, 61 and 85 of Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Dhakoli, District SAS Nagar.

Learned counsel for the petitioner contends that the petitioner is a young boy aged about 18 years and a false case has been planted against him. He further contends that Mukesh Kumar, father of the petitioner has been murdered by certain accused and one FIR No.81 dated 23.09.2024 under Sections 103, 3(5) of BNS, 2023 at Police Station Dhakoli, District SAS Nagar has been registered against the accused in the present case. Learned counsel further

CRM-M-50519-2024 -2contends that there is no other adult male member in the family to take-care of his mother and other family members and he may be granted the concession of interim bail.

On the other hand, learned State counsel has vehemently opposed the prayer made by learned counsel for the petitioner on the ground that the petitioner is involved in a serious crime and may abscond from the process of justice.

I have heard learned counsel for the parties and perused the record.

In the present case, Mukesh Kumar, father of the petitioner was murdered on 23.09.2024 and one FIR No.81 dated 23.09.2024 under Sections 103, 3(5) of BNS, 2023 at Police Station Dhakoli, District SAS Nagar has already been registered in this regard. Further, there is no other adult male member to take-care of his mother, who is already suffering from various ailments. 6.

Keeping in view the abovesaid facts and circumstances of the present case, petitioner is granted 10 days interim bail with effect from 17.10.2024 subject to his furnishing necessary surety bonds/bail bonds to the satisfaction of the concerned Trial Court/Duty Magistrate/CJM. The petitioner is directed to surrender at the jail gate at 05:00 PM on 27.10.2024.

It is made clear that no further extension of time shall be granted under any circumstances.
