Ravinder Kaur v. State Of Punjab And Another
2024:PHHC:028917
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-48967-2019 Date of Decision : February 29, 2024 RAVINDER KAUR -PETITIONER V/S STATE OF PUNJAB AND ANOTHER -RESPONDENTS
CORAM:
HON'BLE MR. JUSTICE KULDEEP TIWARI
Present:
None for the petitioner.
Mr. Pardeep Bajaj, D.A.G., Punjab.
*** KULDEEP TIWARI, J. (ORAL) 1.
Through the instant petition, prayer is made for quashing of FIR No.84 dated 16.09.2018, under Sections 420, 120-B of the IPC, registered at P.S. Bhadson, District Patiala, along with all consequential proceedings arising therefrom.
2.
On the last date of hearing also, i.e. 01.02.2024, none had caused representation on behalf of the petitioner, which led this Court to, in its order dated 01.02.2024, record a clarification that no request for adjournment shall be entertained on the adjourned date. In addition, Court notice was also ordered to be issued to the learned counsel for the petitioner, thereby intimating him about the adjourned date of hearing. 3.
However, today also, despite the learned counsel for the petitioner being duly served through e-mail, as per report of Registry, yet none has caused appearance on behalf of the petitioner. 4.
A perusal of the hereinafter extracted paragraph No.9 of the status report dated 01.02.2024, as filed by the learned State counsel, DEVINDER YADAV 2024.03.01 13:16 I attest to the accuracy and authenticity of this order/judgment
CRM-M-48967-2019 2024:PHHC:028917 makes it amply clear that since the petitioner was avoiding his appearance before the learned trial Court concerned, therefore, the latter was constrained to issue arrest warrants against her. "9. That though the accused/petitioner was released on bail by the Hon'ble Court but she failed to fulfill the conditions laid down in the bail order since she left for abroad without taking any permission from the Ld. Court. Though charge sheet was presented against the accused/petitioner on 25.08.2020 but she did not turn up in the court. Her bailable warrant were issued on 11.04.2022 and then for 21.07.2022 the police made a report that she has gone abroad. Then the Ld. Trial court issued non bailable warrant of arrest against the accused/petitioner for 04.11.2022, 13.02.2023, 10.05.2023, 10.08.2023 and 18.11.2023 but her where about are unknown and now the Ld. Court has fixed the case for 19.02.2024 and her arrests warrants are again issued but she is not appearing before the Ld. Trial court." 5.
Taking into account the act and conduct of the petitioner, besides her remaining unrepresented before this Court despite issuance of specific directions, this Court is not inclined to exercise its extraordinary jurisdiction to grant the asked for relief to the petitioner. Consequently, the instant petition is dismissed.
