Babita Rani v. State Of Punjab And Others
2023:PHHC:137173
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP-24133-2023 (O&M) Date of Decision: 20.10.2023 Babita Rani . . . . Petitioner Vs.
State of Punjab and others . . . . Respondents **** CORAM: HON'BLE MR. JUSTICE SANJEEV PRAKASH SHARMA ****
Present:
Mr. Prince Goyal, Advocate for the petitioner.
**** SANJEEV PRAKASH SHARMA, J.(Oral)
1. Learned counsel for the petitioner submits that the petitioner is due to retire on 30.11.2024. The petitioner has certain injuries and she has been transferred from GSSS, Sri Muktsar Sahib to GSSS, Lambi in District Sri Muktsar Sahib. Learned counsel submits that the distance between Sri Muktsar Sahib and Lambi is about 65 kms.
2. On a specific query asked from the counsel for the petitioner relating to petitioner's period of stay at Sri Muktsar Sahib, learned counsel states that he has no knowledge about the said aspect.
3. However, from perusal of the record, it is apparent that she has been in Sri Muktsar Sahib at least from the year 2015, as she has placed on record medical certificates of 2015 taken from Muktsar.
4. Be that as it may, transfer is an exigency of service and more than one year is left for her services. She has been posted in the same district which essentially does not come within the purview of transfers from one district to another.
