DEEPAK GUPTA , J.(Oral) By way of this petition filed under Section 482 Cr.P.C., petitioner prays to stay the proceedings in criminal complaint bearing No.NACT/338/19 pending before the Court of learned Judicial Magistrate 1st Class, Pehowa, till the petition under Section 125 Cr.P.C. pending before learned Principal Judge, Family Court, Derabassi, is disposed of. Complaint in question, in which petitioner prays for staying the proceedings, pertains to Section 138 of the Negotiable Instruments Act, 1881 (for short 'the N.I. Act'), as filed by respondent No.2-Sarva Haryana Gramin Bank. Said complainant-bank has nothing to do with the petition filed under Section 125 Cr.P.C. by the petitioner against her husband. Apart from above, it is disclosed by learned counsel that the complaint in question under Section 138 of the N.I. Act has reached at the stage of defence evidence/arguments.

In view of the aforesaid situation, there is no justification for staying the proceedings. As such, present petition is hereby dismissed. However, the petitioner will be at liberty to raise all the pleas as taken in this petition before the Trial Court concerned, during his defence.
