**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 148 dated 12.10.2017 under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Kot Isse Khan, District Moga.
Learned counsel for the petitioner submits that the alleged recovery effected from the petitioner is 930 tablets of Alprafresh which is marginally above the commercial quantity.
Learned State counsel submits that out of 10 prosecution witnesses, four witnesses have been examined. Custody certificate dated 9.1.2020 by way of affidavit of Gurjeet Singh Brar, PPS, Deputy Superintendent, Central Prison Faridkot has been filed which is taken on record. As per the custody certificate the petitioner has undergone 02 years and 02 days of actual custody. CRM-M No. 56045 of 2018 -2The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.
Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
