RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for issuance of direction to respondent Nos.1 to 4 to arrest respondent Nos.5 and 6 in case FIR No.250, dated 15.11.2022, under Sections 120-B, 323, 34, 376(2)(n) IPC, registered at Police Station Sadhaura, District Yamuna Nagar, and for granting protection to the life and liberty of the petitioner.

It has been contended by learned counsel for the petitioner that the petitioner has already moved a representation/application, Annexure P-3, to respondent No.3, however, no action has been taken on the same. Notice of motion.

On the asking of the Court, Mr. B.S.Virk, Deputy Advocate General, Haryana, who is present in Court, accepts notice on behalf of the respondent/State.

Heard.

Though the petitioner has already filed a representation for granting her protection and to arrest respondent Nos.5 and 6, however, no MEENU 2022.11.30 17:46 I attest to the accuracy and integrity of this order/judgment

CRM-M-55537-2022 -2direction can be issued regarding arrest as the same is in the domain of Investigating Agency, which is to decide the same on the basis of evidence before it. However, so far as prayer for protection of life and liberty of the petitioner is concerned, respondent No.3, i.e., the Superintendent of Police, Yamuna Nagar, District Yamuna Nagar, is directed to take into consideration the representation, Annexure P-3, filed by the petitioner and decide the same within a period of one month from today in accordance with law.
